Privilegium Minus og Østrig bliver hertugdømme

Baggrunden for Østrigs statsændring fra markgrevskab til hertugdømme var kejser Frederick I's politiske kabale for at beholde Henrik Løves støtte og samtidig undgå fjendskab med Babenbergerne i Bayern. Babenbergerne havde regeret Bayern forholdsvis kort tid, da de først var indsat som hertuger i 1139. Den Babenbergerske hertug, Henrik Jasomirgott, i Bayern var kejser Fredericks onkel på fædrenes side. Kejseren, der havde forfædre både hos Welferne og Babenbergerne, havde som mål at stække de magtfulde bayerske hertuger og samtidig bruge hertugdømmet til at formilde Henrik Løve, der var af Welfernes dynasti, med.

Der skulle derfor handles, så Babenbergerne afstod Bayern mod at få Østrig. Tilbuddet var derfor at marken Østrig blev givet som len til Babenbergerdynastiet, der i vanskelige og langstrakte forhandlinger fra 1153 opnåede at få tilagt kvindelig arvefølge eller i tilfælde af ingen arving, at den siddende fyrste kunne udnævne sin efterfølger - en ret, der ellers tilkom kejseren. Begunstigelserne var dog tidsmæssigt begrænset til den siddende fyrste og hans efterfølger.

Kejseren og Babenbergerne blev enige om en aftale, i hvilken markgrevskabet blev ophøjet til hertugdømme, og de omtalte begunstigelser inkluderet til gengæld for afståelsen af Babenbergernes bayeriske territorium. Henrik Jasomirgott anerkendte ændringerne på rigsdagen i Regensburg i september 1156. Ved den lejlighed, den 8/9, red kejseren usædvanligt til sin vasals teltlejr uden for byen og her - med Henrik Løve til stede - udvekslede de tre herrer faner som tegn på overdragelsen af Bayern og Østrig. Diplomet er underskrevet den 17/09 1156.

Samtidig er der en del, der tyder på, at kejseren allerede under valgforløbet i 1152 lovede Henrik Løve, som tidligere havde msitet Bayern, hertugdømmet tilbage. Modydelsen skulle så være Henriks kampklare og dygtige troppers bistand til kejserens italienske felttog.

Arvefølgestrid mellem efterkommere fra kvindelige linjer efter Friderich II

Da Frederich II (120) faldt i kamp den 15/06 1246 havde han ingen arvinger fået med sine to koner. I henhold til Privilegium Minus fra 1156 var der for den da siddede hertug åbnet mulighed for en kvindelig arvefølge, hvilket nu flere generationer senere alligevel blev anvendt og bragte flere arvekrav frem. Alle fordringshaverne havde beregnet deres krav ud fra slægtslinjer gennem kvindelige klanmedlemmer.

Frederichs havde haft en storebror, Heinrich, der var død i 1228, før faderen Leopold VI (110), men han nåede at få en datter, hertuginde Gertrud af Østrig og Steiermark, der blev gift tre gange, og alle ægtemænd plus den enes søn gjorde arvekrav gældende. Endvidere gjorde den böhmiske kong Premysl Ottokar II gennem sin kone Margarethe, der var søster til Frederich II. Parret havde ingen børn, og Margarethe døde i 1267 barnløs. Da var parret i mellemtiden, 1260, blevet skilt.

Den første prætendent var Gertruds første ægtemand, Markgreve Vladislav af Mähren, krævede hertugtitlen fra 1246 til sin død den 03/01- 1247, så hans krav blev kun et halvt år.

Den næste var Gertruds anden ægtemand, Markgreve Hermann VI af Baden. Han opretholdt kravet til sin død den 04/10 1250, altså godt tre år.

Den tredje var Gertruds tredje ægtemand Prince Roman af Halicx, Greve af Novogrudok. Han døde i 1260. Han krævede hertugkronen i 1252 og 1253, hvor parret blev skilt, og hans krav blev derefter alrig seriøst overvejet af de besluttende tyske kræfter.

Den fjerde var Frederich I af Baden, søn af Gertrud og Markgreve Hermann VI. Han opretholdt kravet til 1268, men var igen fjernet lidt langt fra den afdøde hertug.

Den femte prætendent var Kong Premysl Ottokar II af Böhmen. Han var den 08/04 1252 blevet gift med Frederichs søster Margarethe, der havde været enke i ca. ti år efter sit første ægteskab med den tyske konge Heinrich III af Hohenstaufen, død 1242. Han fik tilkæmpet sig hertugdømmet og magten over Østrig fra 1251, over Steiermark 1260 og over Kärnten fra 1269. Fra han blev skilt fra Margarethe i 1260 satte den tyske konge ham under pres for at afstå hertugdømmerne, men Ottokar ville ikke vige, og to gange måtte den i 1273 udnævnte Kong Rudolf I af Habsburg nedkæmpe Ottokar, der endelig blev afsat i 1276.

Rudolf I overtog selv hertugdømmet og indsatte fra 1282 sine to sønner Albert og Rudolf II som hertuger.

Opdeling af Østrig i henhold til Neubergaftalen 1379

De to brødre regerede sammen de østrigske besiddelser til 1379, hvor de i Neuberg ved Mürz, lidt SE for Wien, den 09/09 delte Habsburgernes territorier imellem sig.

Albert beholdt ærkehertugtitlen for Østrig og dermed de midterste dele af Østrig og områderne mod Böhmen og Ungarn.

Leopold blev regent over hertugdømmerne Steiermark med Wiener Neustadt, Kärnten, Krain (der er det SE-lige område i dag i Slovenien med byen Ljubljana), Windische Mark (der også er en del af nutidens Slovenia), grevskabet Gorizia eller Görz (i dag i NE-Italien i Friuli) samt lidt diffust Vorderlandene til Østrig, der er Habsburgernes spredte besiddelser fra Alsass mod øst tværs over Sydtyskland til det nuværende Østrig.

Den Albertinske linje uddøde i 1457 med Ladislav den Posthume (330), og da var hans områder gået tilbage til efterkommerne af Leopold, nu i den ernestinske underlinje i 1452.

Og alle områderne var igen samlet i 1490, da Grev Sigismund af Tyrol blev købt ud til pensionering, og Ærkehertug Maximilian I derefter regerede som enehersker over det Habsburgske Østrig med tilliggende lande.
